Mothers in Oklahoma have the right to breastfeed in any public location, as long as they are legally allowed to be there. While Oklahoma does have workplace lactation accommodation legislation, it’s equal to, but does not exceed, the federal FLSA’s PUMP Act—which provides workplace lactation accommodation protections for all breastfeeding employees.

OK Breastfeeding Laws: At Work

All breastfeeding employees are protected by the federal FLSA’s PUMP for Nursing Mothers Act and entitled to reasonable break time and a private space (other than a bathroom) to pump at work for one year. Oklahoma has lactation accommodation laws, but they are limited. Oklahoma law mandates that state-owned buildings must provide a lactation space (other than a bathroom) for employees and that state agencies must allow breastfeeding employees break time to pump. Other employers in Oklahoma “may” provide reasonable break time and a private space (other than a bathroom) to pump at work. (Note: the law encourages, but does not require, employers to provide time and space.) Read the law: Okla. Stat. tit. 40, § 435 (2006)

Additionally, Oklahoma passed legislation stating lactating school district employees have the right to reasonable paid break time and access to a secure lactation space (other than a restroom). Read the law: OK SB121
